Dubai Court Awards Dh125,000 in Water Tank Tragedy

Dubai, UAE – A Dubai court has ordered a property owner to pay Dh125,000 in compensation, along with 5% annual interest, to the mother of a seven-year-old boy who died after falling into an unsecured underground water tank on the property.

The court issued its ruling after dismissing all procedural objections raised by the defendants, confirming that the fatal incident resulted directly from negligence and the failure to implement proper safety measures at the site.

Negligence Confirmed by Technical Reports

According to the court documents and expert assessments, multiple safety violations contributed to the tragedy. Key findings concluded that:

  • The water tank cover was left open and unprotected
  • No barriers, fencing, or warning signs were installed
  • Site inspection reports confirmed “insufficient safety measures”
  • Properly securing the tank would have prevented the accident

Technical experts testified that the tank was accessible and inadequately covered, creating a hazardous environment for children and others residing on or visiting the property.

Court Rejects Objections by Defendants

During the hearings, the property owner attempted to challenge the legal grounds of the case, questioning both liability and procedures. However, the judges dismissed all objections, noting that the evidence clearly demonstrated neglect and breach of safety requirements.

The court emphasized that property owners are responsible for ensuring all structures, particularly underground tanks, comply with safety regulations to protect residents and visitors.

Mother’s Compensation Claim Partially Accepted

The mother of the victim- who suffered severe emotional and psychological trauma- had requested a higher compensation amount covering moral, emotional, and financial damages.

While acknowledging the devastating impact of the loss, the court ultimately approved Dh125,000 as compensation and rejected the remaining claims, citing legal limits and the assessed degree of liability.

The ruling aims to reinforce the importance of safety compliance, especially in residential environments where children are present.

A Tragic Reminder of Safety Obligations

This case has sparked renewed discussions about preventive safety measures in residential properties across the UAE. Safety specialists note that proper covering, secured access points, and routine inspections of underground tanks are essential to avoid similar tragedies.

Authorities continue to urge property owners, maintenance firms, and landlords to strictly adhere to safety standards to protect community members-especially children.
